This working paper is a written observation presented by Ewaen Fred Ogieriakhi personally to the Court of Justice of the European Union respecting a preliminary reference in Case C-244/13, Ewaen Fred Ogieriakhi v. Minister for Justice and Equality, Ireland, Attorney General and An Post. It attempts to establish the requirement Union citizens and their family members must satisfy to acquire the right of permanent residence under Article 10(3) of Regulation 1612/68 and Article 16 of Directive 2004/38/EC.
